By accessing or using any part of this website, you agree to be bound by the terms and conditions outlined below. If you do not accept these terms, please do not use this website. These terms may be updated or modified at our discretion without prior notice.
Definitions
For the purposes of these Terms & Conditions:
- “MBA Gas & Electrical Contractor,” “we,” “us,” or “our” refers to the service provider.
- “Customer” or “you” refers to the individual or organisation for whom we are providing services and/or materials.
- “Our representative” refers to any technician or engineer we send to perform work on our behalf.
Service Terms
- Parking and Access: Any parking charges or access-related costs incurred by our engineers during work at your property will be added to the final invoice.
- Multiple Visits: Some work may require more than one visit. In such cases, a diagnosis may be provided during the initial visit, and parts may need to be ordered. A quote will be issued for any further work required. You are under no obligation to accept the quote; however, the call-out fee for the initial visit remains payable.
- Quotations: All quotes include labour and materials unless stated otherwise. Quoted prices are fixed, except in cases of manifest errors. If the scope of work changes or material prices increase, we reserve the right to revise the quote accordingly. If the revised quote is declined, no further charges will apply beyond what has already been agreed upon.
- Appointments: We aim to attend all appointments at the agreed date and time. Work will be completed within a reasonable timeframe, subject to unforeseen circumstances.
Cancellations and Charges
- Job Cancellation: If you instruct us to begin work or order materials and then cancel, we reserve the right to recover any financial losses incurred.
- Late Cancellation Fee: If you cancel within 2 hours of the scheduled time, we may charge:
- 50% of the hourly rate for each hour allocated to the engineer
- 25% restocking fee for any materials ordered
Customer Satisfaction and Complaints
- Satisfaction Guarantee: We do not take payment until you are fully satisfied with the work provided.
- Complaints: If you are dissatisfied, you must notify us in writing within one month of completion. We will inspect the work and, if necessary, carry out remedial work at our expense. You agree to allow our insurer to inspect the work if deemed necessary.
Warranties and Liability
- Warranty Exclusions: We cannot guarantee our work, parts, or equipment if they are:
- Misused or treated negligently
- Altered, repaired, or tampered with by others
- Customer-Supplied Materials: If you supply your own materials, we cannot be held responsible for their suitability or performance.
- Delays: We are not liable for delays caused by circumstances beyond our reasonable control. In such cases, reasonable extensions to the timeline will be granted.
- Gas Work: You accept full responsibility for any hazardous situations regarding Gas Safe compliance. Our engineers operate under their own Gas Safe registration and assume full responsibility for their gas work.
Our Rights
- We reserve the right to:
- Decline or refuse any work that does not comply with our policies or terms
- Choose, at our discretion, who represents us on any given job
Ownership of Goods
All goods and materials supplied remain the property of MBA Electrical Contractor until paid for in full. We reserve the right to seek legal action (including an injunction) to prevent the sale, transfer, or disposal of such items if payment is not received.
Governing Law
All contracts and services are governed by the laws of England and are subject to the exclusive jurisdiction of English courts.
Complaints Procedure
To file a complaint, please email us at info@mbaelectrical.com. We aim to respond within 10 working days.
Your Right to Cancel (Consumer Contracts Regulations 2013)
You have the right to cancel the contract within 14 working days of giving written consent for work to begin. If you cancel during this period, any payments made will be refunded in full.
If you have requested work to begin within the cancellation period, you may be required to pay for:
- Services already carried out
- Materials ordered on your behalf that are non-returnable
